Terms of Service

These Terms of Service ("Terms") govern your access to and use of steadfastto.com, the Steadfast Clothing online store, products, accounts, checkout, customer support, content, promotions, communications, and related services (collectively, the "Services").

By using the Services, creating an account, joining a waitlist, placing an order, clicking to accept these Terms, or otherwise interacting with Steadfast Clothing, you agree to these Terms and the policies referenced in them, including our Privacy Policy and Refund Policy.

1. Acceptance of Terms

You are responsible for reading these Terms before using the Services or placing an order. If you do not agree, do not use the Services or place an order. Nothing in these Terms limits rights that cannot be excluded or restricted under applicable law.

2. Website and Store Use

You agree to use the Services only for lawful, personal, non-commercial shopping and browsing unless we approve another use in writing. You must provide accurate, current, and complete information when using the Services, creating an account, joining a waitlist, or placing an order.

We may update, suspend, restrict, or discontinue any part of the Services at any time, subject to applicable law and orders we have accepted.

3. Account Responsibility

If accounts are available, you are responsible for keeping your login credentials confidential and for all activity under your account. Contact support@steadfastto.com promptly if you believe your account has been accessed without authorization.

We may suspend or close an account where we reasonably believe there has been fraud, misuse, unauthorized access, violation of these Terms, or another security or legal concern.

4. Product Information and Availability

We try to display product photos, colours, pricing, sizes, measurements, materials, care instructions, inventory, and availability accurately. Colours may appear differently depending on your screen, and measurements may vary slightly by style, production batch, or fit.

Products may be offered in limited quantities or limited drops. A product listing does not guarantee availability. If an item becomes unavailable after your order, we may cancel the affected item and refund it, or contact you about alternatives.

5. Pricing, Taxes, Currency, and Errors

Prices are listed in Canadian dollars unless stated otherwise. Taxes, shipping charges, duties, customs charges, and other required fees will be shown at checkout or otherwise disclosed before you complete your purchase where applicable.

If a price, discount, promotion, shipping fee, product detail, or availability detail is listed incorrectly because of an error, we may correct the error and, where appropriate, cancel the order and refund the amount paid.

6. Orders, Payment, Cancellations, and Refusal

When you place an order, you are making an offer to purchase the selected products. We may accept the order by sending an order confirmation, processing payment, or shipping the products. Receipt of an order confirmation does not prevent us from cancelling an order where permitted by law, including for obvious errors, suspected fraud, payment failure, shipping restrictions, or inventory issues.

You authorize Steadfast Clothing and our third-party payment processors to charge your selected payment method for the total amount shown at checkout. Payment methods may be subject to separate terms from your card issuer, bank, wallet provider, buy-now-pay-later provider, or payment processor.

We reserve the right to refuse, cancel, or limit orders where we reasonably believe the order is fraudulent, violates these Terms, is made for unauthorized resale, or cannot be fulfilled. If we cancel an order after payment, we will refund the amount paid for the cancelled items, subject to applicable law.

If you need to cancel or change an order, contact support@steadfastto.com as soon as possible. We cannot guarantee cancellation or changes once an order has been processed, packed, or shipped.

7. Shipping and Delivery

Shipping options, costs, estimated delivery times, and available destinations will be shown at checkout or in any shipping information posted on the website. Delivery times are estimates and may be affected by carrier delays, weather, customs, labour disruptions, address errors, high-volume periods, or events outside our control.

You are responsible for providing a complete and accurate shipping address. If an order is returned because of an incorrect or incomplete address, refusal, non-delivery, or failure to pick up, we may contact you to arrange reshipment at your cost or provide a refund minus non-refundable shipping costs, subject to applicable law.

8. Returns, Exchanges, and Refunds

Returns, exchanges, and refunds are governed by our Refund Policy, which forms part of these Terms. The Refund Policy does not limit mandatory rights under applicable consumer protection, sale of goods, product safety, or similar laws.

9. Promotions and Discount Codes

Promotions, discount codes, gift cards, referrals, giveaways, or contests may be subject to additional terms, eligibility rules, expiry dates, product exclusions, quantity limits, and legal requirements. Promotional offers may not be combined unless we say otherwise.

We may modify, suspend, or cancel promotions where permitted by law, including for suspected fraud, abuse, technical error, or circumstances outside our control.

10. Intellectual Property

The Services and their content, including the Steadfast Clothing name, logos, product names, designs, photos, graphics, text, videos, layouts, look and feel, and other materials, are owned by Steadfast Clothing or our licensors and are protected by intellectual property laws.

You may not copy, reproduce, modify, distribute, sell, display, or exploit any part of the Services or Steadfast Clothing content without our prior written permission, except as permitted by law.

11. User Submissions and Reviews

If you submit reviews, photos, comments, feedback, social media tags, messages, or other content to Steadfast Clothing, you confirm that you have the right to submit it and that it does not violate the rights of others or any law.

You grant Steadfast Clothing a non-exclusive, worldwide, royalty-free license to use, reproduce, display, publish, adapt, and share your submitted content for operating, improving, promoting, and marketing Steadfast Clothing and the Services, subject to our Privacy Policy and applicable law.

12. Prohibited Uses

You agree not to misuse the Services. Without limitation, you must not:

• Use the Services for unlawful, fraudulent, harmful, abusive, harassing, defamatory, misleading, or unauthorized purposes.
• Interfere with website security, attempt unauthorized access, introduce malware, or disrupt the Services.
• Scrape, copy, crawl, harvest, or extract data from the Services except as permitted by us in writing or by applicable law.
• Impersonate another person, misrepresent your identity, or submit false information.
• Use automated tools to purchase limited drop products in a way that is unfair to other customers.
• Infringe or misuse Steadfast Clothing intellectual property or the rights of any third party.
• Resell products in a way that misleads customers or suggests you are authorized by Steadfast Clothing when you are not.

13. Third-Party Services and Links

The Services may use or link to third-party websites, platforms, payment providers, shipping carriers, social media networks, analytics tools, advertising networks, and other services. Third-party services are not controlled by Steadfast Clothing and may have their own terms and privacy policies. We are not responsible for third-party content, policies, or practices except where required by law.

14. Disclaimers and Limitation of Liability

The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we do not guarantee that the Services will be uninterrupted, secure, error-free, or free of viruses or harmful components.

To the fullest extent permitted by law, Steadfast Clothing and its directors, officers, employees, contractors, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption arising from or relating to the Services, products, or these Terms.

To the fullest extent permitted by law, our total liability for any claim arising from or relating to a product, order, the Services, or these Terms is limited to the amount you paid to Steadfast Clothing for the product or order giving rise to the claim. This limitation does not apply where prohibited by law.

15. Indemnity

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Steadfast Clothing from claims, losses, liabilities, damages, costs, and expenses, including reasonable legal fees, arising from your misuse of the Services, violation of these Terms, violation of law, or infringement of third-party rights.

16. Governing Law

These Terms are governed by the laws of Ontario, Canada and the federal laws of Canada applicable there, without regard to conflict of law rules. Subject to any mandatory consumer protection rights that apply in your province, territory, state, or country of residence, disputes will be resolved by the courts located in Ontario, Canada.

17. Changes to These Terms

We may update these Terms from time to time. The updated Terms will be posted on steadfastto.com with a new Last updated date. Changes apply going forward unless otherwise stated. If changes are material, we will provide additional notice where required by law.
